I. DEFINITIONS USED IN THE REGULATIONS MEAN:
1. Customer – a natural person, a legal person or an organizational unit that is not a legal person, to which special provisions grant legal capacity, who places an Order within the Store;
2. Civil Code – Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);
3. Regulations – these Regulations for the provision of electronic services within the online store www.ZaQanna.pl
4. Online Store (Store) – online service available at www.ZaQanna.pl, through which the Customer can place Orders;
5. Goods – products presented in the Online Store;
6. Sales Agreement – a sales agreement for Goods within the meaning of the Civil Code, concluded between ZaQanna and the Customer, concluded using the Store's website;
7. Act on special terms and conditions of consumer sales – Act of 27 July 2002 on special terms and conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141, item 1176, as amended);
8. Act on the provision of services by electronic means – the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws No. 144, item 1204, as amended); 9. Order – a declaration of intent of the Customer, directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of Goods.
II. GENERAL PROVISIONS
2.1. These Regulations define the rules for using the online store available at www.ZaQanna.pl
2.2. These Regulations are the regulations referred to in Article 8 of the Act on the provision of services by electronic means.
2.3. The online store, operating at www.ZaQanna.pl, is run by ZaQanna, registered under the Tax Identification Number (NIP): 9291619848, also referred to as the "Service Provider." Its business address is: Rakietowa Street 29a, 54-615 Wroclaw.
2.4. These Regulations specify in particular:
a.) rules for registering and using an account in the online store;
b.) terms and conditions for making electronic reservations of products available in the online store;
c.) terms and conditions for placing Orders electronically within the online store;
d.) rules for concluding Sales Agreements using the services provided within the Online Store.
2.5. The use of the online store is possible provided that the IT system used by the Customer meets the following minimum technical requirements:
a.) Web browser: Firefox, Google Chrome, Internet Explorer, Opera, Safari with Java Script support
2.6. In order to use the online store, the Customer should obtain access to a computer station or terminal device with Internet access.
2.7. Customers can access these Regulations at any time via the link on the home page of the website www.ZaQanna.pl, download it, and print it.
2.8. Information about the Goods provided on the Store's website, in particular their descriptions, technical and functional parameters and prices, constitute an invitation to conclude a contract, within the meaning of Article 71 of the Civil Code.
2.9. Making purchases via ZaQanna.pl requires the acceptance of cookies by the Customer's browser.
III. RULES OF USE OF THE ONLINE STORE
3.1. Registration takes place by completing and accepting the registration form available on one of the Store's pages.
3.2. Registration is conditional upon consent to the Terms and Conditions and providing personal data marked as mandatory.
3.3. The Service Provider may deprive the Customer of the right to use the Online Store, as well as limit his or her access to some or all of the resources of the Online Store, with immediate effect, in the event of a breach of the Regulations by the Customer, and in particular when the Customer:
a.) provided false, inaccurate or outdated data during registration in the online store, which was misleading or infringed the rights of third parties,
b.) committed an infringement of the personal rights of third parties through the online store, in particular the personal rights of other customers of the online store,
c.) engages in other behaviors that are deemed by the Service Provider to be inconsistent with applicable law or general principles of using the Internet or detrimental to the good name of ZaQanna.
3.4. A person who has been deprived of the right to use the online store may not re-register without the prior consent of the Service Provider.
3.5. In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store takes technical and organizational measures appropriate to the level of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted online.
3.6. The Customer is obliged in particular to:
a.) not providing or transmitting content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties,
b.) use the Online Store in a way that does not interfere with its operation, in particular through the use of specific software or devices,
c.) not to take actions such as: sending or posting unsolicited commercial information (spam) within the Online Store,
d.) use the Online Store in a way that does not cause any inconvenience to other customers, e.) use all content posted on the Online Store only for personal use,
f.) use the Online Store in a manner consistent with the provisions of the law in force in the territory of the Republic of Poland, the provisions of the Regulations, as well as the general principles of using the Internet.
IV. PROCEDURE FOR CONCLUDING A SALES AGREEMENT
4.1. In order to conclude a Sales Agreement via the Online Store, please visit the website www.ZaQanna.pl, select the product, color, size, and perform subsequent technical steps based on the messages displayed to the Customer and the information available on the website.
4.2. The Customer selects the Goods to be ordered by adding them to the shopping cart.
4.3. When placing an Order, the Customer has the option to use a discount code received through specific promotional campaigns. A discount code can only be used once. Discount codes and other promotions cannot be combined.
4.4. When placing an Order – until the "Order with payment obligation" button is clicked – the Customer can modify the entered data and the Product selection. To do so, the Customer should follow the displayed messages and the information available on the website.
4.5. After the Customer using the Online Store has provided all necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding:
a.) the subject of the order,
b.) the unit and total price of the ordered products or services, including delivery costs,
c.) selected payment method,
d.) selected delivery method,
e.) delivery time,
4.6. In order to send an Order, it is necessary to accept the Regulations and the right to withdraw from the contract, provide personal data marked as mandatory and press the "I am ordering with an obligation to pay" button.
4.7. Sending an Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement with the Service Provider, in accordance with the Regulations.
4.8. After placing the Order, the Customer receives an e-mail containing the final confirmation of all essential elements of the Order.
4.9. The Agreement is deemed concluded upon receipt by the Customer of the e-mail message referred to above.
4.10. The sales contract is concluded in Polish, with the content consistent with the Regulations.
4.11. The subject of the contract is only the products presented in the Online Store. All products are new and consistent with the photos displayed in the store. The ZaQanna Store reserves the right to change the color shade of the shipped products compared to the products presented in the Online Store. The ZaQanna Store reserves the right to change the decorative elements in the shipped products compared to the products presented in the Online Store.
4.12. An item in the Store's offer called a "Set" is treated as one product, therefore:
a.) if you wish to withdraw from the contract, please return all products included in the Set to the Store's address,
b.) if you wish to Exchange the Goods, it is only possible to exchange them for a different size of a specific product from the set (it is not possible to Exchange them for a completely different Goods),
c.) if the Set is returned to the Store address in an incomplete number of pieces, the promotion regarding the Set loses its validity and the price of the product from which the Customer does not withdraw becomes the regular price.
4.13. The essential provisions of the Goods Sale Agreement are recorded, secured, made available and confirmed to the Customer by sending a receipt or sales confirmation or order specification or VAT invoice to the Customer's e-mail address, to which the Customer consents.
V. DELIVERY
5.1. Delivery of the Goods takes place to the address indicated by the Customer when placing the Order.
5.2. Delivery of the ordered Goods is carried out via the courier companies DPD, Inpost, Inpost Paczkomaty, DHL and Poczta Polska.
5.3. Delivery within Poland is within 14 business days from the date the payment is credited to our account. In special cases, this period may be extended to 30 days, of which the Customer will be notified via email.
5.5. Customers can access these Terms and Conditions at any time via the link on the home page of www.ZaQanna.pl, download them, and print them. The essential provisions of the Goods Sale Agreement are recorded, secured, made available, and confirmed to the Customer by sending a receipt, sales confirmation, order specification, or VAT invoice to the Customer's email address, to which the Customer consents.
VI. PAYMENT METHODS
6.1. The prices of the Goods are given in Polish zloty and include all components, including VAT (with the rate indicated), customs duties and all other components.
6.2. The customer has the option of making payments:
a.) by bank transfer to the following bank account number: PLN: 26 1140 2004 0000 3102 7663 0266
b.) payment via PayU, PayPo, PayPal, Przelewy24 (the payment card operator is PayPro SA Agent Rozliczeniowy, ul. Pastelowa 8, 60-198 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Poznań Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000347935, Tax Identification Number (NIP) 7792369887, Regon 301345068)
c.) to the courier upon receipt of the order
VII. RIGHT TO WITHDRAW FROM THE CONTRACT
7.1. The Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, has the right – under the provisions of law – to withdraw from a distance contract, without giving any reason, by submitting an appropriate declaration in writing/by e-mail, within 30 days and sending it to the Service Provider's address provided on the Online Store's website.
7.2. The 30-day period is counted from the date on which the Goods were delivered.
7.3. In the event of withdrawal from a distance contract, the contract is deemed null and void. Whatever the parties have provided must be returned unchanged, unless a change was necessary within the scope of ordinary management. The return should be made immediately, no later than 30 days from the date of receipt of the product. Purchased goods should be returned, along with proof of purchase, to the following address: ZaQanna, Rakietowa 29a, 54-615 Wroclaw, Poland
7.4. Goods returned by the Customer should be packaged appropriately to ensure no damage to the shipment during transport.
7.5. The cost of packaging and returning the goods is borne by the Customer.
7.6. Parcels sent by the Customer to the ZaQanna.pl store as cash on delivery will not be accepted.
7.7. If the Customer returns dirty or odorous goods, the goods will be sent to a dry cleaner. The dry cleaner's fee (PLN 50 gross/item) will be deducted from the value of the returned goods.
VIII. COMPLAINTS REGARDING GOODS
8.1. The Service Provider, as a seller, is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code for non-compliance with the Sales Agreement of the Goods purchased by that consumer, to the extent specified in the Act on specific conditions of consumer sales.
8.2. Complaints arising from a violation of the Customer's rights guaranteed by law or under these Terms and Conditions should be directed to the Service Provider. ZaQanna undertakes to review each complaint within 14 days, and if this is not possible, to inform the Customer within that period when the complaint will be reviewed.
IX. COMPLAINTS REGARDING THE PROVISION OF SERVICES BY ELECTRONIC MEANS
9.1. The Service Provider takes steps to ensure the proper operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove any irregularities reported by Customers within a reasonable time.
9.2. The Customer is obliged to immediately notify the company of any irregularities or interruptions in the operation of the Online Store website.
9.3. The Customer may report any irregularities related to the operation of the Store in writing to the Service Provider's address or by email (the email address is provided on the main page of the Online Store).
9.4. In the complaint, the Customer should provide his/her name and surname, correspondence address, type and date of occurrence of the irregularity related to the operation of the Store.
9.5. The Service Provider undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.
9.6. Promotional goods may contain barely visible defects in the material or slight soiling.
X. FINAL PROVISIONS
10.1. Any disputes arising between the Service Provider and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
10.2. Any disputes arising between the Service Provider and the Customer who is not a consumer within the meaning of Article 22[1] of the Civil Code shall be resolved by the court having jurisdiction over the registered office of ZaQanna.
10.3. In matters not regulated in these Regulations, the provisions of the Civil Code, the provisions of the Act on the provision of services by electronic means and other relevant provisions of Polish law shall apply.
10.4 The company reserves the right to make changes to the regulations for reasons such as changes in legal provisions.
